Terms of Service

1. Definitions

  • 1.1 "Company" means 14th Street Software, LLC, the legal entity that owns and operates IBQuiz.
  • 1.2 "IBQuiz" (the "Service") means the Company's web and mobile applications, APIs, Documentation, and related software, branded as "IBQuiz."
  • 1.3 "User," "you," or "your" means any individual who accesses or uses IBQuiz.
  • 1.4 "Content" means all text, images, data, code, questions, answers, and other materials you submit or that are made available through IBQuiz.
  • 1.5 "Subscription" means any paid plan you purchase to access premium IBQuiz features.

2. Eligibility & Account Registration

  • You must be at least 18 years old (or of majority age in your jurisdiction) and legally capable of entering into these Terms.
  • You agree to provide and maintain accurate registration information. You are responsible for all activity under your IBQuiz account.

3. License & Acceptable Use

3.1 License. Subject to these Terms, the Company grants you a revocable, non-exclusive, non-transferable right to use IBQuiz for your personal, educational purposes.

3.2 Acceptable Use. You may not:

  • Reverse-engineer, decompile, disassemble, or derive source code.
  • Scrape, harvest, or mine data.
  • Circumvent security or access-control measures.
  • Use IBQuiz to train AI models, resell, sublicense, or for unlawful purposes.
  • Share login credentials or impersonate another user.

4. Payments & Subscriptions

  • All fees are in USD and non-refundable except as required by law.
  • Subscriptions auto-renew until canceled at least 24 hours before renewal.
  • We use Stripe for payment processing—you agree to Stripe's Terms and Privacy Policy.

5. Content Ownership

  • Your Content. You retain all rights in any Content you submit to IBQuiz.
  • Company Content. All IBQuiz code, designs, interfaces, and Documentation are owned by the Company or its licensors.

6. No Advice; Educational Only

  • IBQuiz provides practice questions, flashcards, analytics, and AI-powered explanations for interview prep.
  • Nothing in IBQuiz constitutes financial, investment, tax, legal, or accounting advice. Consult a qualified professional before acting.

7. Third-Party Services & Export Compliance

  • IBQuiz integrates with third parties (e.g., PostHog, OpenAI, Stripe). Use of those services is subject to their own terms.
  • You agree to comply with all applicable export and import laws and regulations.

8. Service Levels & Changes

  • No SLA. The Company does not promise any particular level of uptime, availability, performance, or response times. IBQuiz is provided "as-available," and features may be suspended, modified, or discontinued without notice.
  • Changes to Terms. We may update these Terms; material changes will be notified at least 30 days in advance. Continued use after the effective date constitutes acceptance.

9. Beta Features

Any beta or early-access features of IBQuiz are provided "as-is," without warranty, and may be removed at the Company's discretion.

10. Termination

  • By You. You may cancel your IBQuiz account at any time via your account settings.
  • By the Company. We may suspend or terminate your access for violation of these Terms, non-payment, or 12 months of inactivity. Upon termination, your Content may be deleted.

11. Disclaimers & Limitation of Liability

  • "As-Is." IBQuiz is provided "as is" and "as available," without warranties of any kind.
  • Content Accuracy. The Company does not guarantee that any quiz question, answer, flashcard, or AI-generated explanation is correct, complete, up-to-date, or suitable for your needs. You should verify facts independently.
  • Limitation. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO IBQUIZ IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID IN THE PRIOR SIX MONTHS OR (B) $100.

12. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its officers, directors, employees, and agents from any claims arising out of your use of IBQuiz or violation of these Terms.

13. Governing Law & Dispute Resolution

  • Governing Law. These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
  • Arbitration. Any dispute arising out of or relating to these Terms or IBQuiz shall be resolved by binding individual arbitration in New York City, under the American Arbitration Association's Commercial Arbitration Rules. Each party bears its own costs, except the arbitrator may award fees as allowed by law. You and the Company waive any right to a jury trial or to participate in a class or representative action.

14. Severability & Entire Agreement

  • If any provision is unenforceable, the remainder shall remain in full force.
  • These Terms (together with our Privacy Policy) constitute the entire agreement between you and the Company regarding IBQuiz.
